The controversial preservation order requiring OpenAI to indefinitely keep records of its ChatGPT data has been terminated. Federal judge Ona T. Wang filed a new order on October 9 that frees OpenAI of an obligation to “preserve and segregate all output log data that would otherwise be deleted on a going forward basis.”

The case kicked off in late 2023, with the New York Times suing OpenAI for copyright infringement, alleging that the AI giant trained its models with the news outlet’s intellectual property without proper compensation. In May of this year, OpenAI was ordered to retain all of its chat logs so that the NYT could investigate claims of copyright violation. In response, OpenAI appealed the court order, arguing that the preservation order was an “overreach” and risks its users’ privacy.

However, this latest decision means the AI giant no longer has to preserve chat logs as of September 26, except for some. The judge in the case said that any chat logs already saved under the previous order would still be accessible and that OpenAI is required to hold on to any data related to ChatGPT accounts that have been flagged by the NYT. Moving forward, the NYT is allowed to expand the number of flagged users, as it continues to comb through OpenAI’s preserved records.

Apple is hiring engineers for an “Answers, Knowledge, and Information” team that is working on improving Siri, Spotlight, Safari, and more.

iOS 18 Siri Personal Context
As of writing, Apple’s careers website has more than a dozen job listings for the team across the U.S. and China. For example, Apple is looking to hire a Staff Machine Learning Engineer to help with “improving Siri’s ability to answer personal domain questions.” The job listing says the team develops large language models that are “responsible for answering users’ questions using their personal documents with privacy at the forefront.”

That sounds a lot like Apple’s personalized Siri features, which were delayed until 2026. However, Bloomberg‘s Mark Gurman says there is more at play here.

In his Power On newsletter today, Gurman said he was told that the team is in the early stages of developing a “new ChatGPT-like search experience,” and it is apparently even exploring a “standalone app” for such functionality.

“While still in early stages, the team is building what it calls an ‘answer engine’ — a system capable of crawling the web to respond to general-knowledge questions,” wrote Gurman. “A standalone app is currently under exploration, alongside new back-end infrastructure meant to power search capabilities in future versions of Siri, Spotlight and Safari.”

Gurman previously reported that Apple was developing a more conversational version of Siri, but he said that it was delayed until at least iOS 27. This would be a more ChatGPT-like version of Siri that is powered by a large language model.

For now, the only thing that Apple has announced is the more personalized version of Siri, which will have better understanding of a user’s personal context, on-screen awareness, and deeper per-app controls. For example, Apple showed an iPhone user asking Siri about their mother’s flight and lunch reservation plans based on info from the Mail and Messages apps. Evidently, though, it looks like Apple has even bigger ChatGPT-like ambitions.

Artificial intelligence (AI) based on large language models (LLMs) has revolutionized the industry. Of these, ChatGPT is probably the best-known and arguably the most sophisticated. Today people turn to ChatGPT to answer questions, have conversations, and share deeply personal stories.

But can you trust ChatGPT with your secrets? A creator recently posed this question in a viral TikTok.

“Imagine telling ChatGPT all your business,” Ms. V (@sweetlifeofv) says in the post. “And somebody else somewhere asking ChatGPT for book ideas and they tell them your story.”

She captions it, “Imagine picking up a book in a bookstore and being like damn this sounds familiar.”

The consensus among top comments on the post is clear: ChatGPT can’t be trusted.

Does AI kiss and tell?

ChatGPT creator OpenAI is currently being sued for copyright infringement. Several newspaper companies, including the New York Times, claim OpenAI used their work to train ChatGPT. They say it has at times provided their work verbatim in response to users’ questions. This suit was consolidated with cases brought by authors including John Grisham, Jodi Picoult, Jonathan Franzen, and Sarah Silverman.

OpenAI has denied infringing the companies’ and authors’ copyrights. The company told the Associated Press, “We build our AI models using publicly available data, in a manner grounded in fair use, and supportive of innovation.”

Researchers have found that ChatGPT does disclose personal information. A 2023 paper by a team from Google claims they were able to obtain the personal information of thousands.

“Using only $200 USD worth of queries to ChatGPT (gpt-3.5- turbo), we are able to extract over 10,000 unique verbatim memorized training examples,” they wrote.

On Saturday, the Mary Sue asked ChatGPT for a book idea. It suggested a tale of a librarian who discovers a book with no title. She initially assumes it’s fiction—until pages start appearing chronicling events in her own life.

ChatGPT further offered to tailor the idea to the Mary Sue’s preferences by making it science fiction or more “grounded.”

OpenAI did not respond to an emailed inquiry sent Saturday morning.

The AI remembers

Whether ChatGPT and other LLM-based AI remember conversations is a matter of some debate. One person in the comments on Ms. V’s TikTok claims they work in AI and it does not.

Its terms say otherwise.

ChatGPT is trained with users’ conversations, according to OpenAI’s website. You can opt-out, however. The company instructs users to click “do not train on my content” in its privacy portal.

You can also ask it to delete their conversations, but at present it will not comply. The judge in the New York Times case recently ordered OpenAI to retain all conversations indefinitely. OpenAI is appealing.

ChatGPT’s terms prohibit users from falsely claiming an idea “was human generated when it was not.” But in the case of a book or other work of art, it could be difficult to prove that the author essentially stole your story from AI.

Ms. V’s post has 3 million views as of this writing. Nearly 4,000 people have commented.

Reactions range from horror to unsurprised.

“You do not have to imagine it, it’s definitely happening,” a comment with 90,000 likes reads. “Your conversations are NOT private.”

A second agreed, “This is 100% what’s happening.”

Another likened it to an episode of Black Mirror.

Many people brought jokes.

“No because after I’m done I told ChatGPT, ‘This is between you and me only ok? Do not tell anyone,’ and it promised me lol,” wrote one.

Ms. V replied, “Not ChatGPT pinky promised!”

Another said, “Please don’t make me think my friend is a snitch. ChatGPT is my bff.”

“I just know it be a psychological thriller,” a third quipped.

  • Goldman Sachs is cautioning its young job-seekers against using AI during the interview process. Instead, the $176 billion bank is encouraging applicants to study up on the firm in preparation. Other businesses like Anthropic and Amazon have also warned candidates against deploying AI—and if they’re caught, they could be disqualified. 

While many companies are boasting about all the efficiencies that will come with AI, some are dissuading potential hires from using it to get a leg up in interviews with recruiters and hiring managers. 

Goldman Sachs’ campus recruitment team for the bank’s private investing academy in EMEA recently sent out an email to students reminding them of its expectations for interviews, as reported by eFinancialCareers. Goldman uses video interviewing platform HireVue to pre-assess candidates and maintains a set of best practices for job-seekers. Based on the best practices guidelines, the young applicants are encouraged to prepare for interviews by studying the $176 billion firm’s financial results, business principles, and core values. But they can’t bank on AI to help them out. 

“As a reminder, Goldman Sachs prohibits the use of any external sources, including ChatGPT or Google search engine, during the interview process,” the email noted, according to someone who saw the message.

HireVue is an AI-powered talent evaluation platform, known for asking behavioral questions that reveal applicants’ skills. Gen Z job-seekers might be tempted to use ChatGPT or other chatbots to game the recruitment process—but it’s discouraged, and isn’t the most viable option. 

The typical Goldman Sachs virtual interview allows for 30 seconds of prep after the question, followed by a two-minute response time, according to research from eFinancialCareers. That makes it hard for job-seekers to quickly type a prompt into the chatbot, churn out an answer, and decide what the line of attack is. Plus, the responses aren’t tailored and unique to the individual, potentially hurting the interviewee more than helping. 

Goldman’s job-seeker AI policy could seem ironic, as half of the firm’s 46,000 employees have access to the technology. But other companies are navigating that same paradox as they try to fully flesh out their AI strategies in an ever-changing technological environment. 

Other companies dissuade applicants from using AI

Goldman Sachs isn’t the only major company warning its applicants not to use AI during recruitment. The $61.5 billion AI giant Anthropic went on a hiring spree last month, but told job-seekers that they can’t use the advanced technology to fill out their applications. The company argued that it wants to test the communication skills of potential hires, and AI use clouds that assessment. 

“Please do not use AI assistants during the application process,” Anthropic wrote in the description for its hundreds of job postings. “We want to understand your personal interest in Anthropic without mediation through an AI system, and we also want to evaluate your non-AI-assisted communication skills.”

Retail giant Amazon also doesn’t like it when potential talent uses AI tools during the recruitment process. Earlier this year, the $2 trillion behemoth shared guidelines with internal recruiters, stressing that candidates who are caught using AI during job interviews should be disqualified. According to Amazon, the tools give an “unfair advantage” that masks analysis of someone’s “authentic” capabilities. 

“To ensure a fair and transparent recruitment process, please do not use gen Al tools during your interview unless explicitly permitted,” the guidelines, as reported by Business Insider, noted. “Failure to adhere to these guidelines may result in disqualification from the recruitment process.”

OpenAI is keeping up its rapid-fire pace of new AI releases. The company introduced the to its ChatGPT platform in April. At the time, the business promised that a pro model of the o3 was on the way, and that version became available today.

Both the o3 and o4-mini models are meant to use and combine all the tools under ChatGPT’s umbrella. When OpenAI adds the “pro” designation to a model, it’s a version that has been built to spend longer answering queries to provide better and more accurate responses. “We recommend using it for challenging questions where reliability matters more than speed, and waiting a few minutes is worth the tradeoff,” the company in the release notes for the o3-pro. In the testing assessments shared, the o3-pro delivered better benchmarks than the o3 and the o1-pro options.

There are some restrictions on the other ChatGPT services the o3-pro can use. Image generation and Canvas are not supported, so users will need to turn to different models for those features. The o3-pro is available today for ChatGPT Pro and Team users, while Enterprise and Edu customers will have access to this option next week.
